O dono de um automóvel atingido pela cancela do pedágio quando passava pelo local através do uso de sistema de cobrança automática será indenizado pela concessionária que administra o trecho por danos materiais.
Segundo o autor da ação, ele trafegava em uma praça de pedágio instalada na BR-101 administrado pela ré quando, em razão de defeito no funcionamento do sistema de pagamento automático, via tag instalado no veículo, a cancela fechou antecipadamente no momento da passagem do veiculo.
Além disso, o carro teria sido atingido por objetos provenientes de obra realizada na pista, sem a devida vigilância pela ré, que causaram avarias no veículo.
