Dra., comprei um imóvel, mas ele apresentou defeitos/vícios (rachadura na parede, reboco irregular e mal feito, dilatação do material, entre outros), e agora?!
O primeiro passo é verificar as possíveis causas do defeito/ vício, bem como a extensão do dano, e, em se tratando de uma rachadura, se está corresponde de fato a problemas na fundação, ou se representa apenas uma trinca ou fissura.
Essa avaliação será realizada por um profissional da área de engenharia civil, o qual deverá elaborar um laudo do imóvel.
A lei permite que o comprador rejeite a obra imperfeita ou defeituosa, podendo, inclusive, solicitar o abatimento sobre o valor pago.
E, caso o vendedor tenha conhecimento dos vícios ou defeitos do imóvel, será responsável por perdas e danos, devendo indenizar/ressarcir o comprador.
