O trabalhador que sofre acidente de trabalho e fica com limitações, poderá pedir judicialmente um pensionamento para o seu empregador.
Mesmo que o trabalhador esteja recebendo benefício do INSS, a empresa pode ser responsabilizada por eventual redução de capacidade laboral, e nesses casos, o trabalhador poderá solicitar que essa pensão vitalícia seja paga mensalmente ou em parcela única.
Esse tipo de indenização, vale tanto para acidentes típicos quanto para doenças originadas pelo trabalho.
