Meu marido abandonou o lar, ele terá direito sobre o nosso imóvel?
Essa é uma dúvida bastante comum, e em alguns casos, ele perderá o direito sim, desde que você solicite a Usucapião Familiar.
Para você ter direito a solicitar essa modalidade de Usucapião, o imóvel de propriedade do casal precisa ter no máximo 250m² (duzentos e cinquenta metros quadrados) e estar localizado em área urbana, na cidade.
Deste modo, se você exercer a posse, sem que o seu ex-marido ou ex-companheiro conteste a propriedade durante um período mínimo de 2 anos, para a sua moradia e a moradia de sua família, você terá direito a solicitar a Usucapião Familiar.
Mas muito cuidado, porque somente é possível, caso você não seja proprietário de outro imóvel, nem utilize esse imóvel para uso comercial.
