O prazo para iniciar o inventário é de 60 dias após a abertura da sucessão, ou seja, da data do falecimento do autor da herança.
Caso não seja realizado dentro desse prazo, existem algumas consequências, dentre elas:
▪️O cônjuge sobrevivente não poderá se casar novamente, exceto pelo regime da separação obrigatória de bens;
▪️Os herdeiros estarão impedidos de realizar a venda, doação, transferência e/ou qualquer negócio que tenha como objeto os bens que integram o espólio (herança), uma vez que a Cessão de Direitos Hereditários é vinculada ao inventário; e
▪️Em alguns Estados, também será cobrada multa sobre o imposto Estadual (ITCMD – Imposto sobre Transmissão Causa Mortis e Doação), em razão de que não houve a abertura do inventário no prazo previsto em lei.
Lembrando que essa multa se encontra suspensa em alguns Estado, inclusive no Paraná.
