Não existe uma tabela que defina os juros abusivos, mas, ao firmar um contrato com a instituição financeira é importante ficar atento ns taxas estipuladas, pois podem estar muito acima da média do mercado.
Para a avaliação sobre possível cobrança abusiva de juros, o primeiro passo é a realização de um cálculo dos juros contratuais comparativamente aos juros da média do mercado.
Embora não haja uma norma expressa que determine quando os juros são abusivos, o ordenamento jurídico oferece instrumentos para que as ilegalidades sejam detectadas. No Brasil, o parâmetro adotado é a diferença em relação às taxas médias de mercado, que são divulgadas mensalmente pelo Banco Central.
Importante destacar a necessidade da contratação de um profissional especializado para realizar o estudo do caso, oportunidade em que poderá ser verificada, também, a existência de outras ilegalidades no contrato pactuado.
