Em caso de venda do imóvel, o inquilino (locatário) possui sim preferência na sua compra, mas o que isso significa?
Resumidamente, caso o proprietário do imóvel decida vendê-lo, deverá comunicar previamente o atual locatário de sua decisão.
E o ideal é que essa comunicação seja realizada por escrito, a fim de evitar problemas futuros, constando o valor e uma proposta para negociação.
Se o proprietário do imóvel não comunicar o locatário, este poderá entrar com ação judicial, solicitando a reparação por perdas e danos, ou ainda, solicitar a aplicação do direito de preferência, com o depósito do valor do imóvel, no prazo de 6 meses a partir da venda (registro em cartório).
Lembrando que existem situações que não possibilitam o exercício do direito de preferência, como nos casos em que a venda é realizada por decisão judicial, permuta, doação, integralização de capital, cisão, fusão ou incorporação.
