A 4ª Câmara de Direito Privado do Tribunal de Justiça de São Paulo manteve decisão da juíza Fabiola Giovanna Barrea, da 3ª Vara Cível de Piracicaba, que condenou uma construtora e uma incorporadora por danos morais após entrega de um imóvel com divergências em relação ao apartamento decorado que foi mostrado ao autor.
A indenização foi fixada em R$ 9 mil, e a pena também inclui a reparação de falhas construtivas e devolução da taxa SATI.
Segundo os autos, a requerida alegou que a decoração exibida era meramente ilustrativa e que os compradores tinham ciência de que a construção seguia os padrões admitidos pelo memorial descritivo, alegação que não foi acolhida pelo Judiciário.
“O material probatório confirma que a publicidade, decisiva para obtenção do consentimento, traiu as perspectivas dos compradores e, por isso, tal como em outras ações, é devida uma compensação para amenizar os percalços dessa improba conduta contratual”, salientou o relator do recurso, desembargador Enio Zuliani.
