Sim, a pessoa com mais de 70 anos pode se casar, porém, será aplicado o regime da SEPARAÇÃO OBRIGATÓRIA de bens, ou seja, todos os bens adquiridos antes e durante o casamento não se comunicam, conservando o domínio exclusivo a um dos cônjuges, em caso de divórcio.
A única hipótese de exceção é quando o casamento é celebrado após longos anos de união estável, a qual se iniciou quando ambos os cônjuges possuíam menos de setenta anos, ou seja, ainda escolhiam livremente o regime de bens.
Nesse regime de bens, em caso de falecimento de um dos cônjuges, o cônjuge sobrevivente somente será herdeiro se não existirem descentes (filhos, netos, bisnetos) e/ou ascendentes (pais, avós e bisavós), sendo chamado em terceiro grau, como um herdeiro universal, herdando a totalidade dos bens.
